The Netherlands Enterprise Agency is the implementing body that, in its own words, supports entrepreneurs and organisations that are making their operations more sustainable, innovating or going international: it designs and administers (subsidy) schemes, contributes to knowledge networks and provides information about laws and regulations. With more than 6,100 staff it is simultaneously a service desk, a permitting authority and a knowledge source. For legal work the last of these matters most: the agency explains how a norm is applied in practice — who measures, with which software, and where the result is registered.

What this source does not give you
Agency texts explain the rule rather than constitute it: the near-zero-energy requirements per building function sit in the Dutch building decree, and where an agency page and the regulation differ, the regulation prevails. Subsidy schemes are moreover time-bound by nature — application windows, budget ceilings and conditions change per round, so a page that is correct today can be out of date next quarter.

Frequently asked questions
- What are the near-zero-energy building requirements, and where do they sit legally?
- Energy performance under the near-zero-energy regime is determined by three separately binding requirements: maximum energy demand in kWh per square metre of usable floor area per year, maximum primary fossil energy use in the same unit, and a minimum share of renewable energy as a percentage. All three must meet their limit value. The requirements have applied to all new construction, residential and non-residential, since 1 January 2021, and stem from the Dutch energy agreement for sustainable growth and from the European Energy Performance of Buildings Directive. The limit values per building function are set out in the Dutch building decree.
- Who may draw up an energy-performance calculation?
- Under the relevant assessment guideline, a detailed-method calculation must be produced both at permit application and at completion, and for apartment buildings both per building and per apartment. Only a certified adviser may draw it up, and must demonstrate that competence with a certificate of professional competence; the survey must be carried out by a firm certified for detailed assessment using attested software. Municipal plan reviewers verify this by looking up the registration in the national energy-label register — a successful registration means those conditions have been met.

- Is agency guidance binding on the municipality assessing a permit application?
- No. The agency administers schemes and provides information about laws and regulations, but does not enact them; the standard against which a building plan is assessed comes from the regulation, not from an agency page. In practice the explanation carries weight, because municipal reviewers and advisers rely on it and it describes the measurement method, certification and registration actually used. So to support a position, cite the regulation and use the agency to show how it is read in implementation practice.
